The prosecution has requested 38 years and one month in prison for the accused of murdering his ex-partner in Barcelona in March 2022, after he filed a complaint against her for allegedly assaulting her.
The trial with the jury, which will be extended until April 30, began on Monday at the Provincial Court of Barcelona with the reading of the written submissions from the parties.
According to the prosecution of the Public Ministry, the accused maintained a romantic relationship with the victim between 2014 and 2021, with whom they had a child together.
During the course of the relationship, he subjected her to «a dynamic of control,» isolating her from the environment and limiting her mobility and autonomy, according to the prosecution.
Additionally, he would engage in «continuous contempt and insults» and frequently subject her to violent physical and psychological attacks, often in the presence of the child, as well as accessing her communications, forcing her to unlock her mobile phone to read both the content of her messages and the recipients.
When the victim decided to end the relationship at the end of 2021, he continued, and even increased, according to the prosecution, both the frequency and intensity of the aggressive behaviors and control over his ex-partner, with «continuous monitoring» and constant calls «to her and her family members, even threatening her on several occasions with bladed weapons.
One of these episodes occurred in February 2022, when he approached her on the street, grabbed her forcefully by the arms, and held a knife to her abdomen to get her to go, along with their child, to his house where he showed her the content of her mobile phone.
She reported him on March 16 of that same year, after seeing him in the company of a new partner, he threw the contents of a beer can, prompting her to report him that same day, and on March 18 of that same month, she returned to the police station to explain the context of their relationship and the «deep fear» he had instilled in her.
Finally, on March 21, «he culminated his purpose of contempt for the woman’s condition and exercised a definitive and total purpose of possession and domination over her,» brutally attacking her, strangling her to death.
The prosecution requests 38 years and one month in prison for the accused as the alleged perpetrator of a habitual abuse offense in the field of gender violence, a continuous offense against privacy for discovery and disclosure of secrets, a harassment offense, a serious threats offense, an abuse offense, a threat offense, and a murder offense with treachery.
Additionally, it considers that there are aggravating circumstances of kinship and discrimination on gender grounds and requests that, before the date of full sentence compliance, he accepts a third degree or parole, that he be expelled from the country.
As for civil liability, it requests that the deceased’s former partner, in addition to assuming the expense of 8,510 euros for funeral expenses, pay 377,500 euros.
On the other hand, the private prosecution, representing the victim’s father and siblings, requests 4 more years in prison by adding an offense against the administration of justice.
